Tennessee Legislature Enacts Amendment Adding Protection for Auto Insurers

 

The Tennessee Legislature has enacted House Bill 685, amending TCA Title 55, Chapter 12 and Title 56, relative to motor vehicle insurance. The bill was signed by the Governor on April 8, 2022 and took effect immediately upon becoming a law.

The enacted amendment includes a new section with specific requirements for entities that employ or contract with drivers who use the drivers’ personal vehicles for the delivery of the entity’s goods or services but does not provide automobile insurance coverage to those drivers. Specifically, at the time of hire, the entity must provide written notification to the driver that:

  1. Requires the driver's signature;
  2. Informs the driver that the driver's automobile insurance may not cover commercial uses; and
  3. Recommends that the driver check with the driver's insurance provider as to whether commercial uses of the driver's personal vehicle are covered.
