Recent SC Supreme Court Decision Held Step-Down Provisions Unenforceable in Auto Policies

 

South Carolina Supreme Court's decision in Nationwide v. Walls holds Nationwide’s step-down provisions that aim to reduce coverage from its auto insurance policy are void, citing its interpretation of section 38-77-142(C) of the South Carolina code in Williams v. Government Employees Insurance Co. (GEICO), 409 S.C. 586, 762 S.E.2d 705 (2014) case.
