Florida Issues Notice for SB 76 Property Claims Litigation Data Call

On January 11, 2023, the Florida Office of Insurance Regulation (OIR) issued a Notice to the Industry regarding the data call for personal and commercial residential property claims litigation reporting.

Pursuant to s. 624.424(11), F.S., beginning January 1, 2022, each authorized insurer or insurer group issuing personal lines or commercial lines residential property insurance policies in Florida shall file with the OIR on an annual basis in conjunction with the statements required by paragraph (1)(a) a supplemental report on an individual and group basis for closed claims. This statute was implemented through Senate Bill 76 (2021), which took effect on July 1, 2021.

All personal and commercial residential property claims closed in Florida during 2022 must be reported. Each company within a group must submit its filing on an individual company basis. Companies are encouraged to begin submitting data as soon as possible.

Filing Deadline: March 1, 2023, 11:59 p.m. ET

Reporting Scope: January 1, 2022 - December 31, 2022

Insurers are to use the Insurance Regulation Filing System (IRFS) for filing submission. IRFS filing instructions can be found here. A copy of the personal and commercial residential property claims litigation data template is available here. The fillable template should be downloaded within IRFS.
