Louisiana Legislature Implements the Hurricane Mediation Program

The Louisiana State Legislature has enacted Senate Bill 212 (Act 591), implementing the "Hurricane Mediation Program" to provide insureds an alternative way to settle residential property insurance claims. The Governor signed the bill into law on June 17, 2022, and it becomes effective on January 1, 2023.

Among other things, the Hurricane Mediation Program requires an insurer to provide an alternative dispute resolution disclosure notice to its insured who has filed a covered residential property insurance claim for property that is located within the geographic area of the named storm or windstorm that is subject to the Governor's declared state of emergency. An insurer shall send the disclosure notice prior to the initial investigation by either the United States Postal Service, electronic mail, or by hand delivery.
